These Terms of Service (the “Terms”) govern your use of https://mcnmmarketing.com (the “Site”), our client portal, and the communications and purchases described below. The Site is operated by MCNM LLC, a Nevada limited liability company doing business as MCNM Marketing (“MCNM,” “we,” “us,” or “our”), located at 5450 West Sahara Ave, Ste. 320, Las Vegas, NV 89146.
By using the Site, requesting a marketing audit, creating an account, making a purchase, signing in to our client portal, or contacting us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Who May Use the Site
The Site is intended for businesses and for people who are at least 18 years old. If you use the Site on behalf of a company or organization, you confirm that you have the authority to accept these Terms for it, and “you” includes that organization.
Our Services and Your Service Agreement
The Site describes the digital marketing services we offer, including search engine optimization, local SEO and Google Business Profile management, website design, marketing automation and CRM setup, paid advertising, and content and reputation management. Client engagements are governed by a separate written proposal, order, or service agreement (a “Service Agreement”). If a Service Agreement conflicts with these Terms, the Service Agreement controls for that engagement. These Terms cover the Site itself, purchases made through it, our client portal, and our communications with you.
No Guarantee of Results
Marketing results depend on factors outside our control, including search engines and advertising platforms such as Google and Meta, their algorithms and policies, your market and competitors, your budget, the condition of your website, and your cooperation. We do not guarantee any particular search ranking, traffic level, number of leads, cost per lead, ad performance, sales, or revenue. Case studies, examples, and testimonials on the Site describe past work and are not a promise of future results.
A free marketing audit is a general assessment based on the information and data available to us at the time. It is provided for informational purposes only, is not legal, financial, or other professional advice, and does not create any obligation for you or for us.
Client Portal and Branded Links
Clients may be given access to our client portal at app.mcnmmarketing.com, and forms, calendars, invoices, and payment pages we send may be hosted at link.mcnmmarketing.com. The portal runs on a third-party platform that we license. Your use of the portal is subject to these Terms, your Service Agreement, and the platform provider’s acceptable use requirements. You are responsible for keeping your login credentials confidential, for all activity under your login, and for making sure the information you enter is accurate. Tell us right away at contact@mcnmmarketing.com if you believe your account has been accessed without permission.
Accounts
If you create an account on the Site, you agree to provide accurate information and to keep it current. You are responsible for your password and for everything that happens under your account. We may suspend or close accounts that violate these Terms, that appear fraudulent, or that have been inactive for an extended period.
Purchases, Pricing, and Payment
Prices on the Site are listed in U.S. dollars and may change without notice. Applicable taxes are added at checkout where required. Payments are processed by third-party processors such as WooPayments (powered by Stripe) and PayPal under their own terms; by submitting an order you authorize the charge. We may cancel or refuse an order because of a pricing or description error, suspected fraud, or unavailability, in which case we will refund any amount already charged for that order.
Refunds and cancellations are governed by our Refund Policy, together with any product description, checkout terms, or Service Agreement that applies to your purchase. If you have a question about a charge, contact us before disputing it with your bank so we can resolve it quickly.
Communications, Calls, and Text Messages
When you give us your phone number or email address, you agree that MCNM may contact you by phone, email, and text message (SMS or MMS) about your inquiry, your audit, and our services. Where you have opted in, we may also send marketing messages. Some calls and texts may be placed with automated technology. Consent to marketing messages is not a condition of purchasing anything from us.
Text messaging. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, and reply HELP for help. Carriers are not liable for delayed or undelivered messages. We do not share your mobile opt-in or consent with third parties for their own marketing purposes.
Calls and AI assistant. Calls with us may be answered or followed up by an AI assistant and may be recorded, transcribed, and summarized so we can respond to your request and keep accurate records. By continuing a call after you are told it may be recorded, you consent to the recording. If you prefer not to be recorded, email us instead.
You can unsubscribe from marketing emails using the link in any message. We may still send transactional messages about services you have requested.
Intellectual Property
The Site and everything on it, including text, graphics, logos, page layouts, audits, guides, videos, and software, are owned by MCNM LLC or its licensors and are protected by copyright, trademark, and other laws. MCNM, MCNM Marketing, and our logo are trademarks of MCNM LLC. Client names and logos shown on the Site belong to their respective owners and are used to describe our work.
We grant you a limited, revocable, non-exclusive license to view and print Site content for your own evaluation of our services. You may not copy, republish, scrape, sell, or create derivative works from Site content, or use our trademarks, without our written permission. If you send us ideas or feedback, we may use them without any obligation to you.
Your Submissions
You keep ownership of the information and content you submit through forms, chats, comments, or reviews. You grant MCNM a non-exclusive, royalty-free license to use it to respond to you, deliver our services, operate and improve the Site, and, for public comments and reviews, to display it. You are responsible for what you submit and agree not to submit anything that is unlawful, misleading, infringing, defamatory, or spam. We may edit or remove submissions at our discretion.
Acceptable Use
You agree not to:
- Use the Site or client portal in any way that violates the law or these Terms
- Access another person’s account or data, or attempt to bypass any security or access controls
- Use bots, scrapers, or other automated tools to collect content or data from the Site
- Introduce malware, interfere with the Site’s operation, or place an unreasonable load on our infrastructure
- Submit false contact information, impersonate anyone, or use our forms or phone numbers to send spam
- Reverse engineer, resell, or sublicense any part of the Site or client portal
Third-Party Websites and Services
The Site links to and relies on websites and services we do not control, including Google, Meta, our client portal platform, payment processors, and client websites. Those services have their own terms and privacy policies, and we are not responsible for their content, availability, or practices. A link on the Site does not mean we endorse the linked site.
Disclaimer of Warranties
The Site, the client portal, and all content and free resources are provided “as is” and “as available.” To the fullest extent permitted by law, MCNM disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any content is accurate or current. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, MCNM and its members, managers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, lost data, or loss of business opportunity, arising out of or related to the Site, the client portal, or these Terms, even if we were advised of the possibility of such damages. Our total liability for any claim arising out of the Site or these Terms will not exceed the greater of the amount you paid us through the Site in the twelve months before the claim arose or one hundred U.S. dollars ($100). Liability under a Service Agreement is governed by that agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless MCNM and its members, managers, employees, and contractors from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site or client portal, your submissions, or your violation of these Terms or of any law or third-party right.
Governing Law and Disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at contact@mcnmmarketing.com and give us thirty (30) days to try to resolve the dispute informally. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief to protect its intellectual property.
Termination
We may suspend or terminate your access to the Site or client portal at any time if we believe you have violated these Terms or if continued access would create a risk to MCNM, our clients, or others. Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.
Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date above. Continued use of the Site or client portal after changes are posted means you accept the updated Terms.
General
These Terms, together with our Privacy Policy and any Service Agreement, are the entire agreement between you and MCNM about the Site. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. You agree to receive notices from us electronically, including by email and by posting on the Site.
